Purchase procedure (describe the purchase procedure)

To make an online purchase, it is an essential requirement that you register as a user of the website. You can browse the website until you find the desired item. Once located, clicking on it will give you access to all the detailed information offered by the website. From there, you can add the item to your purchase.

When placing the order, you will be asked to enter all your data and finally confirm the order.

Once the purchase procedure is finished, you can select whether you want to generate an electronic invoice, which will be sent to the User via email. You can also request a paper copy of your invoice.

Contract with INSTITUTE BCN ESTHETICS, S.L. and acceptance of orders.

The order will not be accepted by us until the amount has been charged to our account. Upon confirming the purchase, you will receive an e-mail as confirmation of acceptance. Only at that moment will the contract between you and us be formalized, and only for the items listed in said shipping confirmation.

Confirmation and cancellation of orders

Prior to the completion of the order by you on the website, you can review all details associated with it (amounts broken down into all necessary sections – taxes, transport costs, item selection, etc.), and correct what you deem necessary.

After confirmation, it will not be possible to modify or cancel the order through the website. You must contact us. In such a case, the order can only be modified or canceled if the item has not entered the shipping phase from our warehouses.

Currency, tax, and prices

In accordance with the provisions of Law 37/1992, of December 28, on Value Added Tax (VAT), all purchases from our website will be subject to value added tax. The applicable rate will be the one legally in force at each moment.

All prices are shown in Euros (€) and do not include taxes, unless, due to legal requirements, especially regarding VAT, a different matter is indicated and applied.

Payment methods and security

Any order placed must be paid immediately after order confirmation. Only orders for which payment has been completed and verified will be processed.

Payment must be made by bank transfer, credit and debit card, and PayPal.

Credit and debit cards: The order amount will be charged to your card, so you must provide the number, expiration date, and the CW2 security code (on the back of your card). If your card is secured (e.g., 3D Secure), you will be asked for the relevant security codes.

This data will not be saved or manipulated by us but will be registered directly on the payment gateway of the corresponding financial institution. The charge will be made in real-time through this payment gateway. If the charge cannot ultimately be carried out (for any reason), the order will be automatically canceled.

Bank transfer: The customer has 5 business days to make the payment, or the order will automatically be considered canceled. The customer can pay for their order to the account shown below, indicating the order number obtained at the end of the process. This system allows purchases of any economic amount. At the end of the order, you will receive an e-mail with all the details. Please note that this payment method is not immediate, and it may take up to 48 hours for us to receive payment confirmation.

Important: As the concept of the transfer, you must indicate the order number that will appear at the end of this process. If this reference is not indicated, the order will be canceled.

PayPal: Allows sending payments online securely and conveniently. PayPal's network builds on the existing financial infrastructure of bank accounts and credit cards to create a global, real-time payment solution. Deliveries: types, deadlines, and problems

Once payment is received, your order will be prepared. You can select whether you want to receive it at a postal address or pick it up at our physical store.

In-store pickup

If you buy before Xh, your order will be ready in 24h (working days). Order processing hours are from 09:00 to 16:00, every working day from Monday to Friday. Orders placed outside this time frame will be processed on the next working day.

You can pick up your online order during business hours (specify) at the address C/ TELÈGRAF, 15 - 08160 - MONTMELÓ (BARCELONA).

Shipments

As a general rule, packages are sent within 24/72h (working days) following receipt of payment, via Nacex.

Except in those cases where there are unforeseen or extraordinary circumstances or, where applicable, arising from the customization of the products, the purchase order consisting of the products listed in each purchase confirmation will be delivered within the period indicated on this website according to the shipping method selected by the User and, in any case, within a maximum period of 30 calendar days from the date of order confirmation.

If, at the time of delivery, the order packaging is damaged, you must open the package in the presence of the logistics operator to verify the condition of the items. If damage is observed, you must detail it on the delivery note and contact us. We will repair or replace, free of charge to you, all items that have been damaged or lost during transport, provided that you notify us of such an incident as soon as possible.

Once the order is delivered, it will become your property, and therefore, all damages that may arise will be your responsibility.

Return, withdrawal, exchange, and refund policy

Returns

In cases where the User purchases products on or through the owner's Website, they have a series of rights, as listed and described below:

Right of Withdrawal

The User has the right to withdraw from this contract within 14 calendar days without needing justification. The withdrawal period will expire 14 calendar days from the day that you or a third party indicated by you, other than the carrier, acquired material possession of the goods.

To exercise the right of withdrawal, the User must notify us at: INSTITUTE BCN ESTHETICS, S.L., accounts@institutebcn.com, of their decision to withdraw from the contract through an unequivocal statement. You may use the model withdrawal form below, although its use is not mandatory.

To meet the withdrawal deadline, it is sufficient for the communication concerning the exercise of this right by the User to be sent before the corresponding period expires.

Consequences of withdrawal:

In the event of withdrawal by the User, we will refund all payments received from you, including delivery costs (with the exception of additional costs resulting from your choice of a delivery method other than the least expensive ordinary delivery method we offer) without any undue delay and, in any case, no later than 14 calendar days from the date on which we are informed of your decision to withdraw from this contract. We will proceed to make said refund using the same payment method used by the User for the initial transaction, unless the User has expressly provided otherwise; in any case, you will not incur any expenses as a result of the refund.

“You must return or deliver the goods directly to us at INSTITUTE BCN ESTHETICS, S.L., VIA AUGUSTA, 2 BIS 5 PLANTA - 08006 - BARCELONA” or “We will collect the goods”, without any undue delay and, in any case, no later than 14 calendar days from the date you communicate your decision to withdraw from the contract. The deadline will be considered met if you return the goods before said period has expired.

You must bear the direct cost of returning the goods. This cost is estimated to be approximately X euros at most. (if INSTITUTE BCN ESTHETICS, S.L. collects the goods, describe cost)

The User must return the Products in perfect condition; otherwise, the product may suffer depreciation. Consequently, the User is informed that they will be responsible for the decrease in value of the products resulting from handling other than that necessary to establish the nature, characteristics, and functioning of the goods. That is, if the product is not returned with the original packaging or in perfect condition, INSTITUTE BCN ESTHETICS, S.L. may charge the cost of the product's devaluation.

The User acknowledges knowing that there are exceptions to the right of withdrawal, as set forth in Article 103 of Royal Legislative Decree 1/2007, of November 16, which approves the consolidated text of the General Law for the Defense of Consumers and Users and other complementary laws. By way of example, and not exhaustively, this would be the case for: goods made to the consumer and user's specifications or clearly personalized, the supply of goods that may deteriorate or expire quickly, the supply of sealed goods that are not suitable for return for reasons of health protection or hygiene and that have been unsealed after delivery, the supply of goods that after delivery and taking into account their nature have been inseparably mixed with other goods.

Return of defective products or error in shipment

This refers to all cases in which the User considers that, at the time of delivery, the product does not conform to what is stipulated in the contract or purchase order, and therefore, must contact INSTITUTE BCN ESTHETICS, S.L. immediately and let them know of the existing non-conformity (defect/error) by the same means or using the contact details provided in the previous section (Right of Withdrawal).

The User will then be informed on how to proceed with the return of the products, and these, once returned, will be examined, and the User will be informed, within a reasonable period, whether a refund or, where appropriate, a replacement is applicable. The refund or replacement of the product will be carried out as soon as possible and, in any case, within 14 days following the date on which we send you an email confirming that the refund or replacement of the non-conforming item is applicable. The amount paid for those products that are returned due to a defect, when one truly exists, will be refunded in full, including delivery costs and the costs the User may have incurred to make the return. The refund will be made by the same payment method that the User used to pay for the purchase. In any case, the rights recognized in the legislation in force at all times for the User, as a consumer and user, will always be respected.

Warranties

The User, as a consumer and user, enjoys guarantees on the products that can be acquired through this Website, in the terms legally established for each type of product. In the case of a sales contract for goods or the supply of digital content or services supplied in a single act or in a series of individual acts, INSTITUTE BCN ESTHETICS, S.L will be responsible for the lack of conformity that exists at the time of delivery or supply and becomes apparent within a period of three years from delivery in the case of goods or two years in the case of digital content or services, without prejudice to the provisions of Article 115 ter, paragraph 2, letters a) and b).

In this sense, it is understood that the products comply with the contract provided that: they conform to the description made by INSTITUTE BCN ESTHETICS, S.L. and possess the qualities presented therein; they are fit for the uses to which products of the same type are ordinarily destined; and they present the usual quality and performance of a product of the same type that are reasonably expected of it. When this is not the case regarding the products delivered to the User, the User must proceed as indicated in the section Return of defective products or error in shipment. However, some of the products sold on the Website may present non-homogeneous characteristics as long as these derive from the type of material they were made with, and which will therefore form part of the individual appearance of the product, and will not be a defect.

On the other hand, it could be the case that the User acquires a product on the Website from a brand or manufactured by a third party. In this case, when it is impossible or entails an excessive burden for the User to address the business owner due to the lack of conformity, the User also has the possibility of contacting the brand or manufacturer responsible for the product to find out how to exercise their legal warranty right directly against them during the three years following the delivery of said products. To do this, the User must have kept all information regarding the product warranty.

3. PARTIAL NULLITY

If any part of these conditions of service were contrary to law and, therefore, invalid, this will not affect the other provisions that comply with the law. The parties undertake to renegotiate those points of the conditions of service that are null and to incorporate them into the rest of the conditions of service.

4. MODIFICATION OF THE GENERAL CONDITIONS OF SALE

INSTITUTE BCN ESTHETICS, S.L. reserves the right to modify the general conditions of sale without prior notice, being able to change, delete, or add both the content and services presented through it and the way in which these appear presented or located on its servers.

These changes must be accepted by the user each time they make a purchase of a product or service effective through the web.

In the event that some of the terms of the general conditions of sale are declared integral or non-opposable by a judicial decision, the other provisions will remain in force.

5. APPLICABLE LAW AND JURISDICTION
