By placing an order, you guarantee that you are over 18 years of age and have the legal capacity to enter into binding contracts.

Orders may only be placed to purchase goods not intended for resale. Any resale or distribution of the products purchased through this website is strictly prohibited.

We reserve the right to cancel fraudulent, false or speculative orders, as well as those placed by a customer with whom there may be any disagreement or dispute in relation to previous orders, or where there are reasonable grounds to believe that the customer is carrying out any criminal activity.

User obligations

As a User, you are obliged to provide INSTITUTE BCN ESTHETICS, S.L. with all the data necessary to access and use the services of this website. The data provided must be truthful and up to date. You should also be aware that we may use them to contact you when necessary.

It is essential that you provide all the information we classify as mandatory, since otherwise we will not be able to process your order. We shall not be liable, under any circumstances, for any delays or errors in delivery resulting from incorrect or missing data.

The User must make appropriate use of the services included on this website, always in accordance with the law, and shall not carry out any activity that hinders or interferes with its operation.

Security measures

We will put in place all reasonable mechanisms within our reach to ensure that your personal data are kept secure at all times.

Purchase procedure

You may browse the website until you find the desired item. Once located, by clicking on it you will access all the detailed information offered on the website. From there you can add the item to your purchase. When placing the order you will be asked to enter all your details and, finally, to confirm the order.

Once the purchase procedure has been completed, you may choose to generate an electronic invoice, which will be sent to the User by email. The invoice will be issued in Spanish and English. You may also request a paper copy of your invoice.

The personal data necessary to process the order will be processed in compliance with reasonable security measures and the applicable laws and regulations in force and, in particular, in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data (GDPR), and with Spanish Organic Law 3/2018 of 5 December on the Protection of Personal Data and the guarantee of digital rights, as well as the rights of Users in accordance with the privacy policy of this Website.

Scope of the offer

The products offered and marketed through the Website may be purchased and shipped to any country or territory in the world, except for those countries or territories in which there is an exclusive distributor officially appointed by the brand owner. In such cases, the marketing, distribution and/or sale of the products in those territories shall be reserved to the corresponding exclusive distributor.

During the purchase process, the User must indicate the delivery address. If the destination address indicated is not within the territorial area in which INSTITUTE BCN ESTHETICS, S.L. provides the shipping service, the order cannot be completed.

If the User wishes to receive an order at a different destination, they may contact INSTITUTE BCN ESTHETICS, S.L. using the contact form or the email address provided for that purpose, so that the feasibility of the shipment and the applicable conditions can be assessed.

Availability

All orders are subject to availability. We are not responsible for lack of stock or unavailability of products.

Please check the selection of items available for sale through the website, as not all items that we may offer in our shops or that may appear in catalogues, websites or other presentations are available for this type of sale.

In the event of any lack of stock or temporary unavailability of an item, INSTITUTE BCN ESTHETICS, S.L. will contact the customer immediately to inform them and offer a new delivery date or, if it is not possible to supply the product, proceed to cancel it.

Contract with INSTITUTE BCN ESTHETICS, S.L. and acceptance of orders

The order will not be accepted by us until the amount has been charged to our account. When you confirm the purchase, you will receive an email confirming acceptance. Only at that moment will the contract between you and us be formalised, and only for the items listed in said shipping confirmation.

Confirmation and cancellation of orders

Before completing the order on the website, you will be able to review all the details associated with it (amounts broken down under all the necessary headings – taxes, shipping costs, item selection, etc.) and correct anything you consider necessary. After confirmation it will not be possible to modify or cancel the order through the website; you must contact us. In this case, the order may only be modified or cancelled if the item has not yet entered the dispatch phase from our warehouses.

Currency, taxes and prices

In accordance with Spanish Law 37/1992 of 28 December on Value Added Tax (VAT), all purchases made from our website will be subject to value added tax. The applicable rate will be the one legally in force at any given time.

All prices are shown in Euros (€) and do not include taxes, unless a different treatment is indicated and applied by legal requirement, especially with regard to VAT. VAT is applied before completing the order and corresponds to the rate required in each country.

Prices may change at any time, but any changes will not affect orders or purchases already made by the User.

Payment methods and security

Any order placed through the Website must be paid at the time of purchase. Only orders for which payment has been correctly completed and verified will be processed.

Card: To make the payment, the User must enter their card details in the secure payment gateway provided for that purpose.

Bank card details are not stored or processed by INSTITUTE BCN ESTHETICS, S.L., but are managed directly by the corresponding payment service provider, which applies the security measures required by current regulations and industry standards.

If the payment cannot be authorised or verified for any reason, the order will not be considered formalised and will be cancelled automatically, without the products being shipped.

Bank transfer: The customer has 5 working days to make the payment, otherwise the order will be automatically cancelled. The customer can pay for their order to the account shown below, indicating the order number obtained when completing it. This system allows purchases of any amount. When you complete the order, you will receive an email with all the details. Please note that this payment method is not immediate and it may take up to 48 hours for us to receive payment confirmation.

Important: The order number shown at the end of this process must be indicated as the transfer reference. If this reference is not indicated, the order will be cancelled.

PayPal: Allows you to send payments over the Internet securely and conveniently. The PayPal network builds on the existing financial infrastructure of bank accounts and credit cards to create a global real-time payment solution. PayPal offers a service especially designed for those who are not satisfied with traditional payment mechanisms.

Deliveries: types, lead times and issues

Once payment has been received, INSTITUTE BCN ESTHETICS, S.L. will prepare the User's order for delivery or collection, according to the method selected during the purchase process.

Physical deliveries of products will be made to addresses anywhere in the world, provided that the shipping service is available for the destination indicated during the purchase process.

Products will be delivered to the address indicated by the User when placing the order.

The estimated delivery times are as follows:

Except in cases of unforeseen or extraordinary circumstances or circumstances beyond the control of INSTITUTE BCN ESTHETICS, S.L., or when the order includes personalised or made-to-order products or products with specific preparation times, the order will be delivered within the period indicated on the Website according to the shipping method selected by the User.

In any case, the order will be delivered within a maximum of 30 calendar days from the date of purchase confirmation, unless another period has been expressly agreed with the User. Upon delivery, the User must check the external condition of the package. If the packaging shows damage, dents, openings or signs of tampering, it is recommended to note this on the carrier's delivery document and, if possible, check the contents in the presence of the courier.

If the User finds that the product has arrived damaged or incomplete, or that there is any error in the shipment, they must inform INSTITUTE BCN ESTHETICS, S.L. as soon as possible through the contact channels provided, attaching, if possible, photographs of the packaging and the affected product.

INSTITUTE BCN ESTHETICS, S.L. will handle the incident and, where appropriate, will repair, replace, redeliver or refund the affected product at no additional cost to the User, provided that the damage, loss or error is attributable to the carrier or to INSTITUTE BCN ESTHETICS, S.L.

Once the order has been delivered to the User, or to a third party authorised by them, the risks relating to the products shall pass to the User, without prejudice to the rights to which they are entitled as a consumer and user in accordance with current legislation.

Shipping costs

Shipping costs will be calculated and shown to the User during the purchase process, before placing the order, depending on the shipping method selected and the destination indicated.

For mainland Spain, all orders are shipped free of charge.

For the islands, the shipping cost varies according to weight and we ship via NACEX.

The cost of shipping outside Spain is calculated based on the weight of your order. Shipping costs are shown in detail during the purchase process.

The User can check the total amount of the order, including applicable shipping costs, before confirming the purchase.

Returns, withdrawal, exchange and refund policy

Returns

Where the User purchases products through the Website owned by INSTITUTE BCN ESTHETICS, S.L., they are entitled to the rights described below, in accordance with current consumer and user protection legislation.

Right of withdrawal

The User has the right to withdraw from the contract within 14 calendar days without giving any reason.

The withdrawal period will expire 14 calendar days from the day on which the User, or a third party indicated by them other than the carrier, acquires physical possession of the goods.

To exercise the right of withdrawal, the User may communicate their decision by means of any unequivocal statement.

For this purpose, INSTITUTE BCN ESTHETICS, S.L. makes available to consumers an electronic withdrawal function, visible and easily accessible from the Website, which allows the withdrawal request to be submitted electronically.

Without prejudice to the above, the User may also exercise the right of withdrawal using the withdrawal form or by sending a written communication by email or by post to the contact details indicated in these General Terms and Conditions.

The electronic withdrawal mechanism will allow the User to submit their request electronically and expressly confirm their intention to withdraw from the contract. Once the request has been submitted, INSTITUTE BCN ESTHETICS, S.L. will send the User, without undue delay, an acknowledgement of receipt of the withdrawal on a durable medium, usually by email, indicating the content of the request and the date and time of submission.

The User may also use the model withdrawal form at the end of these terms and conditions, although its use is not mandatory.

To meet the withdrawal deadline, it is sufficient for the communication concerning the exercise of this right to be sent before the corresponding period has expired.

Effects of withdrawal

If the User withdraws, INSTITUTE BCN ESTHETICS, S.L. will reimburse all payments received, including delivery costs, with the exception of any additional costs resulting from the User's choice of a type of delivery other than the least expensive type of standard delivery offered.

The refund will be made without undue delay and, in any case, no later than 14 calendar days from the date on which INSTITUTE BCN ESTHETICS, S.L. is informed of the decision to withdraw from the contract.

INSTITUTE BCN ESTHETICS, S.L. will make the refund using the same means of payment used by the User in the initial transaction, unless the User has expressly agreed otherwise. In any event, the User will not incur any fees as a result of the refund.

However, INSTITUTE BCN ESTHETICS, S.L. may withhold the refund until it has received the goods back or until the User has supplied evidence of having sent them back.

The exercise of the right of withdrawal will entail the return of the goods covered by the contract following the procedure established by INSTITUTE BCN ESTHETICS, S.L.

Direct return by the User

The User must send back or hand over the goods directly to INSTITUTE BCN ESTHETICS, S.L., VIA AUGUSTA, 2 BIS 5 PLANTA - 08006 – BARCELONA (Spain), without undue delay and, in any case, no later than 14 calendar days from the date on which they communicate their decision to withdraw from the contract. The deadline is met if the User sends back the goods before the period has expired.

The User will bear the direct cost of returning the goods.

The User must return the products in good condition and, whenever possible, with their original packaging, accessories, instructions and documentation. The lack of the original packaging will not prevent the exercise of the right of withdrawal; however, the User will be liable for any diminished value of the products resulting from handling other than what is necessary to establish their nature, characteristics and functioning.

If the product shows depreciation resulting from improper use, handling or storage, INSTITUTE BCN ESTHETICS, S.L. may deduct the corresponding, duly justified, diminished value from the refund.

Exceptions to the right of withdrawal

The User acknowledges that there are exceptions to the right of withdrawal, in accordance with article 103 of Spanish Royal Legislative Decree 1/2007 of 16 November approving the Consolidated Text of the General Law for the Protection of Consumers and Users and other complementary laws.

By way of example and without limitation, the right of withdrawal will not apply in the following cases:

• Goods made to the User's specifications or clearly personalised.
• Goods that are liable to deteriorate or expire rapidly.
• Sealed goods which are not suitable for return due to health protection or hygiene reasons and which have been unsealed after delivery.
• Goods which, after delivery and due to their nature, have been inseparably mixed with other items.
• The supply of digital content not supplied on a tangible medium, such as e-books, digital magazines, digital publications, audiobooks or any other downloadable or online content, where supply has begun with the User's prior express consent and their acknowledgement that they thereby lose the right of withdrawal.
• The supply of digital services where performance has begun, with the User's prior express consent, during the withdrawal period and with their acknowledgement that, once the service has been fully performed, they lose the right of withdrawal.
• Any other case in which current legislation expressly excludes the exercise of the right of withdrawal.

Return of defective products or shipping errors

Where the User considers that, at the time of delivery, the product does not conform to the contract or to the order placed, whether due to a defect, damage or a shipping error, they must contact INSTITUTE BCN ESTHETICS, S.L. as soon as possible and report the issue detected.

INSTITUTE BCN ESTHETICS, S.L. will inform the User how to return the product. Once received, the product will be examined and the User will be informed, within a reasonable period, whether replacement, repair, refund or another legally provided solution applies.

If the existence of a defect, damage or error attributable to INSTITUTE BCN ESTHETICS, S.L. is confirmed, the refund or replacement will be made without undue delay and, in any case, within the legally applicable period.

The amount paid for products returned due to a defect or error, once duly confirmed, will be refunded in full, including delivery costs and any reasonable costs incurred by the User in making the return.

The refund will be made using the same means of payment used by the User for the purchase, unless another means is expressly agreed.

All of the above is without prejudice to the rights to which the User is entitled as a consumer and user in accordance with current legislation.

Guarantees

The User, as a consumer and user, enjoys guarantees on the products they may purchase through this Website, under the terms legally established for each type of product.

In the case of a contract for the sale of goods or for the supply of digital content or services supplied in a single act or in a series of individual acts, INSTITUTE BCN ESTHETICS, S.L. will be liable for any lack of conformity existing at the time of delivery or supply that becomes apparent within three years of delivery in the case of goods, or two years in the case of digital content or services, without prejudice to the provisions of article 115 ter, section 2, letters a) and b).

In this regard, products are deemed to conform to the contract provided that they: match the description given by INSTITUTE BCN ESTHETICS, S.L. and possess the qualities presented therein; are fit for the purposes for which products of the same type are ordinarily used; and offer the quality and performance usual in a product of the same type that can reasonably be expected.

Where this is not the case with respect to the products delivered to the User, they must proceed as indicated in the section «Return of defective products or shipping errors». However, some of the products sold on the Website may have non-uniform characteristics, provided that these derive from the type of material from which they are made and therefore form part of the individual appearance of the product and do not constitute a defect.

On the other hand, the User may purchase on the Website a product of a brand or manufactured by a third party. In this case, where it is impossible or excessively burdensome for the User to address the seller regarding the lack of conformity, the User may also contact the brand or manufacturer responsible for the product to find out how to exercise their right to the legal guarantee directly against them during the three years following delivery of such products. To this end, the User must have kept all the information relating to the product guarantee.

PARTIAL NULLITY

If any part of these terms of service is contrary to law and therefore invalid, this will not affect the other provisions that comply with the law. The parties undertake to renegotiate those points of the terms of service that are declared null and void and incorporate them into the rest of the terms of service.

CHANGES TO THE GENERAL TERMS AND CONDITIONS OF SALE

INSTITUTE BCN ESTHETICS, S.L. reserves the right to modify the general terms and conditions of sale without prior notice, and may change, delete or add both the contents and services offered and the way in which they are presented or located on its servers.

These changes must be accepted by the User each time they purchase a product or service through the website.

In the event that any of the terms of the general terms and conditions of sale is declared null or non-binding by a court decision, the remaining provisions will remain in force.

APPLICABLE LAW AND JURISDICTION

This site is located and operated from Spain. All matters relating to this site shall be governed by Spanish law and submitted to the jurisdiction of the competent Courts and Tribunals of Spain, without application of the principles of conflict of laws.

In cases where the customer is not a consumer or user, or is domiciled outside Spain, they shall submit to the Courts and Tribunals of Lleida, expressly waiving any other jurisdiction that may correspond to them.

If the User decides to use or consult this site from outside Spain, they must bear in mind that they do so on their own initiative and will be responsible for complying with the applicable laws.

This contract shall enter into force and take full effect from the moment it is accepted by the customer or User.

This contract and, therefore, the general terms and conditions it incorporates, together with any annexes (if any), in addition to being available on this website, may be stored, archived and reproduced by the usual electronic or computer means.

COMPLAINTS AND CLAIMS

The User may send INSTITUTE BCN ESTHETICS, S.L. their complaints, claims or any other comments using the contact details provided at the beginning of these Terms and Conditions (General Information). Likewise, INSTITUTE BCN ESTHETICS, S.L. has official complaint forms available to consumers and users, which they may request from INSTITUTE BCN ESTHETICS, S.L. at any time using the contact details provided at the beginning of these Terms and Conditions (General Information). In the event of a dispute between INSTITUTE BCN ESTHETICS, S.L. and the User, the User, as a consumer, may request an out-of-court dispute resolution, in accordance with Regulation (EU) No 524/2013 of the European Parliament and of the Council of 21 May 2013 on online dispute resolution for consumer disputes.
